These Terms of Service ("Terms") govern your use of the Dyno mobile application (the "App") and related services provided by Dyno Health, Inc. ("Dyno," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

Description of Service

The Dyno app helps users track testosterone replacement therapy (TRT) and related health metrics including medication protocols, dosing logs, symptom check-ins, lab results, and facial measurements.

The App can be used without an account (data stored locally on your device) or with an account (data encrypted and synced to our servers for backup, cross-session access, and AI-powered insights).

Medical Disclaimer

Important: The Dyno app and any associated hardware are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information obtained through the App.

The Dyno at-home testosterone testing device is in development. It is not FDA cleared or approved and is not for sale. Any measurements or readings should not be used to make medical decisions.

AI-Powered Features

If you create an account, the App may use artificial intelligence to analyze your health data and provide personalized insights, trend analysis, and observations. You understand and agree that:

  • AI-generated insights are for informational purposes only and are not medical advice
  • AI analysis may be inaccurate, incomplete, or inappropriate for your individual situation
  • You should not rely on AI-generated content to make health or medical decisions
  • Your health data may be processed by third-party AI services (currently Anthropic) to generate insights, subject to our Privacy Policy

Account Registration

To access cloud sync and AI features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

Apple HealthKit

The App may request permission to read health data from Apple HealthKit (such as sleep, heart rate, and activity data). This data is used solely to enhance your health tracking experience within the App. We will never use HealthKit data for advertising or share it with third parties for their marketing purposes.

Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age.

User Responsibilities

You agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not use the App as a substitute for professional medical care
  • Consult with healthcare professionals before making any health-related decisions
  • Maintain the security of your device and account to protect your data
  • Not attempt to access other users' accounts or data
  • Not reverse engineer, decompile, or disassemble the App

Intellectual Property

The App and its original content, features, and functionality are owned by Dyno Health, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the App, including AI-generated insights.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DYNO HEALTH, INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party
  • Any content obtained from the App, including AI-generated insights
  • Unauthorized access, use, or alteration of your data
  • Any health decisions made based on information from the App

Indemnification

You agree to defend, indemnify, and hold harmless Dyno Health, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.

Account Termination

You may delete your account at any time by contacting us at hello@joindyno.com. We will delete your account data within 30 days of your request. We may also terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide notice by updating the "Last updated" date and, if you have an account, by sending you an email notification. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
