These Terms of Service ("Terms") govern your use of the Dyno mobile application (the "App") provided by Dyno Health, Inc. ("Dyno," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

The Dyno app is designed to help users track and log testosterone measurements and related health data. The App stores all data locally on your device.

Medical Disclaimer

Important: The Dyno app and any associated hardware are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information obtained through the App.

The Dyno device is a concept product in development. It is not FDA cleared or approved and is not for sale. Any measurements or readings should not be used to make medical decisions.

Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age.

User Responsibilities

You agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not use the App as a substitute for professional medical care
  • Consult with healthcare professionals before making any health-related decisions
  • Maintain the security of your device to protect your data

Intellectual Property

The App and its original content, features, and functionality are owned by Dyno Health, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any information provided through the App.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DYNO HEALTH, INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party
  • Any content obtained from the App
  • Unauthorized access, use, or alteration of your data

Indemnification

You agree to defend, indemnify, and hold harmless Dyno Health, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
